Image Use and Licensing Using and buying my images

The photographs on this site are my original work. The collection of over four thousand images taken around north-west England and the Scottish Highlands and Islands represent years of dedicated work and I am therforefore very protective of my images. I don't want them to be copied without my knowledge and I certainly don't want them to be used in any way that might cause offence to another person. I believe I have always acted responsibly when when taking the shots. I have never wanderered onto private land, taken close-ups of people without their permission, or caused distress to wildlife.

I am approachable and usually delighted that you want to use my images, but please have the courtesy to ask. Please also contact me if you don't find what you're looking for in the tables below, or you have any other queries.

Please note that my images must never be used for:

* Obscene or libelous works

* Depicting a model in a manner that might cause distress

* Sub-licensing, giving away or sharing my image files

* Any logo or trademark.

* On-line print on demand products.

1. Free website use of my photographs

All photographs on the website are copyright, so please contact me for permission to use or copy them.

Photography is my passion and the thousands of photos on this site represent years of dedicated work. I am therefore very protective of my images and grateful that modern technology enables me to track any unauthorised use. I am approachable and usually delighted that you want to use my images, but please have the courtesy to ask. Usually permission will be granted for photos to be downloaded free of charge for both commercial and non-commercial use within a website.

* Please email with details of intended use and enclose a link to the relevant page on your site.

* The copyright wording must not be removed from the image.

* There should be a direct hyperlink to my website or to a page within my site. If your website has content that may be of interest to my visitors we could possibly arrange to include a mutually beneficial reciprocal link.

* Please do not crop any images. If you need an image to fit a particular template, let me know the dimensions and I will crop it to scale.

* Please do not link directly to an image.

2. Buy an image file for personal use

Buy the file and get the photo printed and framed as you wish. This option is for personal use only and is ideal for overseas customers. The file will be emailed to you via the secure file transfer service, 'You Send It'

If you choose to print personal greetings cards from my image please credit Joan Bryden Photography on each card.

No products must be sold from the use of my image and it must not be shared or given away. It is for your personal use only.

The sizes shown below are the suggested maximum sizes for producing good prints on photographic paper. If printing on canvas or non-photographic paper, you will be able to print larger images.

3. Edtorial use of my photographs: Books, magazines, newspapers and educational literature:

As soon as I have reviewed and accepted your intended usage of the image, it will be emailed to you via the secure file transfer service, 'You Send It' .

Please credit Joan Bryden Photography and send me a complimentary copy of any publication in which the reproduction of the image appears.

4. Commercial Use of my Photographs: Advertising, advertorial work and the production of saleable goods.

Terms and Conditions of Reproduction of Images

TERMS AND CONDITIONS OF SUBMISSION AND REPRODUCTION OF IMAGES

“We and/or “Us” means Joan Bryden. “You” means the person or entity named as the client (as addressed on the invoice or email). You will be deemed to have accepted these terms and conditions unless you notify us to the contrary and return the images to us within 7 days of receipt. No variation of these terms or conditions shall be effective unless agreed in writing.

“Image” means any item that may be offered for the purposes of reproduction.

Supply of images

All Images belong to us.

We will deliver Images to you by the most appropriate safe method, and may invoice you for the delivery costs.

Rights are granted on a strictly one time, one edition, non-exclusive use, unless agreed otherwise in writing.

Re-use of Images without written permission from us is forbidden.

Licence for Use of Images

The reproduction by whatever means of the whole or any part of any Image is strictly forbidden without our specific written permission. You must inform us of your proposals as to when and how an Image is intended to be used. We will then consider whether we would wish to grant a licence and, if so, on what terms.

No reproduction rights are granted by virtue of delivery of Images unless expressly indicated. Your right to reproduce an Image arises only if

(a) licence terms are agreed and

(b) our invoice relating to the grant of such right is fully paid.

Any reproduction before payment of the invoice or outside the terms of any licence constitutes an infringement of copyright and a breach of this Agreement entitling us to rescind and claim damages. You must indemnify us in respect of any claims, damages, costs or expenses we incur arising from any reproduction of any Image supplied to you.

You must satisfy yourself that all necessary rights, model releases or consents which may be required for reproduction are obtained and that the use of any Image is not obscene, indecent, libellous or unlawful. We make no claim or warranty with regard to your use of content, names, text, people, trademarks or copyright material depicted in any Image and you will indemnify us in respect of any claims, damages, costs or expenses we incur arising from the use of any Image supplied to you.

Reproduction rights (if granted), unless otherwise agreed in writing are

(a) subject to these terms and conditions and any terms and conditions set out in the delivery note and licence,

(b) non-exclusive reproduction rights for single use only in the United Kingdom. A single use means a reproduction in one size for one edition of a single publication, published in one language only,

(d) personal to you and not assignable by you to any third party,

If we agree that you may license the use of any Image to any third party, you shall enter into an Agreement with such third party to ensure that they are bound by licence terms restricting printing, copying, networking, multiple access or other use of the Images to personal use only, forbidding the assignment, resale, rental and lending of the Image and ensuring that credit is given to us and the author.

You must credit Joan Bryden every time an Image is used. If you fail to credit the Image an additional 50% of the original licence fee will be payable.

For images used on websites © Joan Bryden Photography has a direct link to http://www.wildcardwalks.co.uk preferably on the same page.

Images shall not be altered or manipulated, added to, or have any part deleted without our prior written consent.

You must provide us on publication with at least one complimentary copy of any publication in which the reproduction of the image appears. For websites, please supply the full URL addresses of any pages containing our images.

Digital Use of Images

You acknowledge that Images are our valuable property, as are any digital Images created from the Images (“Digital Images”).

You may not create, store or transmit Digital Images without our permission except so far as is incidentally and wholly necessary to the process of producing items licensed by us. If permission is granted the following conditions apply:

Each Digital Image created by you shall be recorded and labelled with the Image reference number used by us and our copyright credit information as an integral part of the Image file, and held on an electronic database under your sole possession and control.

You agree to destroy all Digital Images including any pre-press or pre-production copies of the Images and any copies or records of the Images held on a database within 90 days of the date of receipt of the Images or completion of the maximum production run, or expiry of the licence term, whichever is later.

Miscellaneous

While we take reasonable care in the performance of this Agreement, we shall not be liable for any loss or damage suffered by you or by any third party arising from use or reproduction of any Image or its caption. Damages for any other breach shall be limited to the licence fee paid by you.

You must pay our invoice within 30 days of issue unless otherwise agreed.

Until we have invoiced the reproduction fee neither party is committed to grant or to acquire any reproduction rights in any Image. After a fee has been agreed and an invoice issued there is a firm and binding contract, whereby we are committed to grant reproduction rights and you to acquire them. If after invoicing but before payment you request cancellation of the rights, we may at our discretion cancel subject to you paying a Cancellation Fee.

If you do not pay in accordance with these terms then we may at our option rescind this Agreement and recover damages, or charge interest at the rate prescribed by the Late Payment of Commercial Debts (Interest) Act 1998 from the date payment was due until payment is made.

Any licence granted will terminate immediately if you (a) die, (b) enter into voluntary or compulsory liquidation; (c) have a receiver appointed; or (d) fail to perform any of your obligations under these Terms and Conditions within 28 days of our giving you notice to comply. In the event of termination, all rights granted will immediately revert to us and any further exploitation of any Image shall constitute an infringement of copyright.

Any publication right (as defined in the Copyright and Related Rights Regulations 1996) arising from your use of any Image shall vest in us and you hereby assign all such rights arising to us.

Our failure to exercise or enforce any of our rights will not be deemed a waiver of such rights nor bar their exercise or enforcement in future.

Should any disagreement arise between us, we shall, if we both agree, first try to settle it by a mediation procedure.

These Terms and Conditions shall be governed by the laws of England and Wales and the parties agree to submit the jurisdiction of the English courts, such jurisdiction to be exclusive, save for infringement of copyright or non payment of our invoices where it will be non-exclusive.
